Grievance Procedure

This procedure applies to employees of Liberty House Recovery Café.

Purpose

Liberty House Recovery Café (RC) believes that fulfillment of its mission of service requires the unity of purpose and spirit of all its employees. Employees are encouraged to discuss questions, issues, and concerns with their supervisors or the Executive Director at any time.

Definition

A grievance shall be any complaint arising from an interpretation or application or perceived violation of these personnel policies or procedures.

Informal Grievance Procedures

An employee should first attempt to resolve a grievance or complaint through discussion with his/her immediate supervisor. Every effort will be made to find an acceptable solution by informal means. If the grievance is not resolved through the informal procedure, the formal grievance procedure described below may be utilized.

Formal Grievance Procedures

The formal grievance procedure provides for a sequence of actions which may be pursued towards resolution of the dispute. In order to begin or continue the process, the submission of the grievance to each level must be made within the specified time. If the designated party fails to meet the response deadline, the employee may proceed to the next step of the procedure. The time limits may be extended if mutually agreed upon by the employee and management. In addition, depending upon the situation, the Executive Director may bypass or shorten or extend the time span of any step in the grievance process discussed below. The formal procedure is as follows:

  1. The employee must advise his/her immediate supervisor in writing of the grievance within 30 days of the incident being grieved. The grievance must identify the employee's understanding of the facts and the remedy being sought. A sample Grievance Resolution Form is in the Appendix of Forms at the end of this Manual. The supervisor should respond in writing within 10 working days of receiving the grievance.

If the employee is not satisfied with the written response of the supervisor, he/she has five working days from receiving the supervisor's response to submit a written appeal to the Liberty House Recovery Café Executive Director. The employee should indicate the issues still unsolved following the previous step.

  2. Liberty House Recovery Café's Executive Director may meet with the employee and supervisor and will respond within 10 working days of receiving the written appeal.

If the employee is not satisfied with the written response of the RC Executive Director, he/she has five working days from receiving the Executive Director's response to submit the grievance to the Chairperson of the Board of Directors. The Chairperson may then meet with the employee and those supervisory employees that he/she believes appropriate and will give RC's final response within 10 working days.

If the Chairperson of the Board of Directors is the Executive Director of Liberty House Recovery Café, this grievance procedure will either end with step 2 above or continue with one or more members of the RC Board of Director's Executive Committee. The course of action shall be in the sole discretion of the Liberty House Recovery Café Executive Director.
